Crash Synopsis:

UNIT 3 TRAVELING NORTHBOUND ON SR 209. UNIT 2 WAS FOLLOWING UNIT 3. UNIT 1 was traveling southbound. UNIT 3 then PULLED OFF the northbound lane ONTO the northbound SHOULDER. Unit 2 and Unit 1 collided to the left of Unit 3. Unit 2 then struck Unit 3 as a result of the collision with Unit 1. Operator 3 and the passenger of Unit 3 appeared to be uninjured. Operator 2 and the passenger of Unit 2 along with Operator 1 were injured and flown from the scene.

AT THIS POINT, THE INVESTIGATION CONTINUES TO DETERMINE WHICH UNIT IS AT FAULT FOR THE CRASH. (12-01-2008 at 10:10AM)

Narrative:

The location of this three vehicle crash is on a TWO LANE CONCRETE BRIDGE on SR 209, which is approximately 66 feet East of Beechwood Inn Road. At this location, SR 209 travels in a North/South direction. The roadway was DRY and had CLEARLY MARKED DOUBLE YELLOW CENTER LINE AND WHITE FOG LINES. There were no adverse weather conditions at the time. THE FINAL RESTING POINT OF UNIT 1 AND 2 WAS ON THE CENTER OF THE ROADWAY. UNIT 3 WAS DRIVEN A FEW FEET NORTH BY OPERATOR 3 FROM ITS FINAL RESTING POINT AFTER THE COLLISION. UNIT 3 WAS PARKED ON THE NORTHBOUND SHOULDER UPON MY ARRIVAL (Officer Jason Beers).

This three vehicle crash occurred as Unit 1 was traveling South on Sr 209. UNIT 2 AND 3 WERE TRAVELING NORTH. UNIT 3 PULLED OFF OF THE ROADWAY ONTO THE NORTHBOUND SHOULDER. As Unit 2 was passing Unit 3 on the left, Unit 2 collided with Unit 1 ON THE NORTHBOUND LANE HEAD ON. This impact caused unit 2 to spin counter-clockwise and the left side of the rear bumper of Unit 2 collided with the left side of Unit 3. UNIT 1 AND UNIT 2 CAME TO A FINAL UNCONTROLLED REST ON THE CENTER OF SR 209. Unit 3 was driven from its final rest a few feet North by Operator 2.

This Trooper (Officer Jason Beers) examined Units 1, 2 & 3 at the scene and observed the following:

I OBSERVED THAT UNIT 1 HAD MAJOR DAMAGE TO THE FRONT.

I observed that Unit 2 had major damage to the front and a scuff mark on the left side of the rear bumper.

I observed damage to the left side of Unit 3.

Upon arrival at the scene, Operator 2 and the passenger of Unit 2 (Mr. & Mrs. J. Rhoades) were being extracted by West End Fire Co. Operator 1 (Mr. Senavitis) was being treated for injuries inside a West End ambulance. I was unable to interview Operator I on scene, due to his injuries and need of medical attention. I IDENTIFIED OPERATOR 1 VIA A DRIVERS LISENCE. Upon Operator 2 and passenger of Unit 2 being extracated, I was unable to interview either of them due to their injuries and need of medical attention. I IDENTIFIED OPERATOR 2 AND PASSENGER OF UNIT 2 THROUGH WEST END EMT’s.

On 10-17-08 at approx. 1900 hours, I interviewed Witness 1 (Al Guevera of Allentown, PA) on the scene. He stated HE SAW UNIT 3 PULL ONTO THE NORTHBOUND SHOULDER TO USE HER CELL PHONE. He stated there was A FEW SECONDS BEFORE UNIT 2 PASSED IT. He stated he then SAW AND HEARD UNIT 2 AND UNIT 1 COLLIDE WITH EACH OTHER. He stated Unit 2 then collided with Unit 3.

On 10-17-08 at approx. 1910 hours, I (Officer Jason Beers) interviewed Operator 3 on scene. She stated SHE PULLED ONTO THE NORTHBOUND SHOULDER OF THE ROAD TO USE HER CELL PHONE. She stated SHE CAME TO A COMPLETE STOP AND DID NOT EVEN PUT HER VEHICLE INTO PARK WHEN SHE HEARD THE CRASH occur to the left of her. She stated her vehicle was struck by Unit 2 AFTER UNIT 2 WAS STRUCK BY UNIT 1. She stated she then PULLED HER VEHICLE UP A FEW FEET in case Units 1 & 2 caught on fire. She stated she checked on her baby then called 911.

Units 1 & 2 were towed by MATTS Towing back to MATTS impound yard.

ASSISTING AT THE SCENE WERE SGT. ROBERT CASTNER, CPL.KEVIN FLANNERLY AND TROOPER VITO CUSUMANO OF PSP FERN RIDGE. ALSO ASSISTING WERE THE WEST END FIRE/RESCUE AND EMS.

On 10-17-08 at approx. 2300 HOURS, I (Officer Jason Beers) interviewed WEST END EMT, CHARLES (NMN) FRANTZ (DOB 2-7-75, 50 Ransberry Ave. East Stroudsburg PA 18301). He stated he was treating Operator 1 on the scene for injuries, he noticed the odor of AN ALCOHOLIC BEVERAGE EMITTING FROM OPERATOR 1’S BREATH OR BODY.

Operator’s 1, 2 & 3 were all identified through Pennsylvania J-NET using the name’s and date of birth that I received at the scene. A check of the operator’ driving records she that they had valid drivers’ licenses.

On 10-18-08 at 0935 hours, Operator 2 was pronounced dead at Lehigh Valley Hospital, Salisbury Twp. By Arjumand ALI. MD. Operator 2’s death was caused by multiple blunt force trauma, due to a motor vehicle accident; the manner of death was ruled accidental. (A copy of the death letter w3as mailed to me (Officer Jason Beers) by Coroner, Scott M. GRIM, D-ABMDI. Death notification was made to the next of kin via Lehigh County Coroner.

On 10-18-08, myself (Officer Jason Beers) and Cpt. Kevin FLANNERLY assisted Cpt. Douglas SHOOK of the PSP CARS Unit with TAKING MEASUREMENT OF THE CRASH SCENE.

On 10-18-08, at approx. 1830 hours, I (Officer Jason Beers) interviewed WITNESS 2(Eric K. Golab). He stated he WAS TRAVELING NORTH ON SR 209 and was the SECOND VEHICLE BEHIND UNIT 2. He stated he SAW Unit 3 PULLED ON THE NORTHBOUND SHOULD OF SR 209. He state UNIT 2 VEERED TO THE LEFT WHEN IT PASSED UNIT 3. He stated UNIT 2 DID NOT DRIVE OVER THE DOUBLE YELLOW LINES INTO THE SOUTHBOUND LANE. He state HE SAW UNIT 1 VEER TOWARDS THE NORTHBOUND LANE, CROSS THE DOUBLE YELLOW LINES AND ENTER THE NORTHBOUND LANE. He stated HE SAW UNIT 2 SWERVE TO THE RIGHT, AWAY FROM UNIT 1 BUT STILL GOT STRUCK. He stated Unit 2 then struck Unit 3. He stated HE APPROACHED UNIT 1 (pick up truck driven by Mr. Senavitis) and saw Operator 1 lying across the floor of Unit 1.

ON 10-21-08, A SEARCH WARRANT WAS OBTAINED TO SEIZE THE MEDICAL RECORDS OF OPERATOR 1 FROM ST. LUKES HOSPITAL, BETHLEHEM. PA. A TOXICOLOGY REPORT ONLY LISTED THE MEDICAL BLOOD RESULTS. ON 10-22-08 ANOTHER SEARCH WARRANT WAS OBTAINED TO SEIZE THE ACTUAL BLOOD OF OPERATOR 1 FROM ST. LUKES HOSPITAL. THE BLOOD WAS SEIZED AND TRANSPORTED TO PSP WYOMING LAB FOR TESTING. THE BAC RESULTS ARE PENDING. (12-01-08 10:10AM),

On 10-27-08 at 1111hours, I (Officer Jason Beers) interviewed the passenger of Unit 2 (Mary Edith Rhoades). She stated that the LAST THING SHE REMEMBERED WAS OPERATOR 2 SHOUT SOMETHING LIKE “HOLD ON” or “ WATCH OUT”. She stated the next thing SHE REMEMBER SEEING HEADLIGHTS COMING AT HER IN THE NORTHBOUND LANE. She stated the headlights looked to be higher than Unit 2. She stated she then felt the impact of the crash. She stated the next thing she remembers was the fire and EMT’s trying to get her out of the car. She stated she heard somebody asking operator 2 (Senator James Rhoades) questions.

On 10-27-08 at 1402 hours, I (Officer Jason Beers) interviewed Operator 1. He stated he was on his way home from his employer which is Midas in Stroudsburg, PA. He stated he had cashed his check at PNC bank which is near Midas. He stated all he remembers is driving and seeing a car in front of him coming at him. He stated there was no one else is Unit 1 with him. He stated he is unsure if he was wearing a seatbelt. I asked Operator 1 if he remembered what lane the car was coming at him was in. He stated the car was in his lane.

This incident was logged on the PSP I-Net in accordance with FR-6-4.

A Notice of Crash Investigation was mailed to Operator 1. A NOTICE OF CRASH INVESTIGATION ALONG WITH VICTIM/WITNESS ASSISTANCE GUIDES WERE MAILED TO THE OPERATOR 2’S WIFE AND OPERATOR 3.

A NEWS RELEASE WAS PREPARED AND SUBMITTED. (12-1-08 l0:l0AM this was printed by PA State Police – Fern Ridge)

THIS CASE USING MR. AND MRS. SENAVITIS FOR THEIR SCAPGOATS.
